1. Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of Today's Video, available at talkupchat.org (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. What the Service is

Today's Video turns publicly trending topics into short, AI-generated story videos. You pick a trend (or provide a prompt), the Service drafts a fictional micro-story, and — if you choose to spend a credit — renders it into a video you can download and share.

All generated stories and videos are fiction. They are creative works inspired by trending topics, not news, journalism, or factual reporting. Generated content may be inaccurate, incomplete, or depict events that never happened, and must not be presented as fact. The Service is not affiliated with or endorsed by the subjects of any trend.

3. Accounts

You must create an account (managed by our authentication provider, Clerk) to use most features. You are responsible for the activity that happens under your account and for keeping your credentials secure. You must be at least 13 years old — and old enough to consent to these Terms in your jurisdiction — to use the Service.

4. Plans, credits, and billing

Rendering videos requires a paid subscription. One credit renders one video (“1 credit = 1 video”). Drafting story scripts is free on every tier.

  • Subscriptions renew monthly. Your plan's included credits reset on the first day of each calendar month, regardless of your billing date; unused plan credits do not carry over. Purchased top-up credits do carry over.
  • Top-up packs are one-time purchases available to active subscribers. Top-up credits roll over from month to month and are spent only after your monthly plan credits are used.
  • Failed renders refund automatically. If a render fails, the credit is returned to the balance it was spent from. This automatic credit refund is the remedy for failed renders; cash refunds are otherwise at our discretion and subject to applicable law.
  • Cancellation is self-serve at any time via the Stripe billing portal (Settings → Manage subscription). Your plan remains active until the end of the current billing period; top-up credits require an active subscription to spend.
  • Payments are processed by Stripe. Prices are in USD and may change; we will give notice before a price change affects an existing subscription.

5. Free tier

Free accounts can browse today's trends and watch or share videos. Creating content — story drafts and video renders — requires an active subscription. Each plan includes a daily story-draft allowance (drafts do not consume credits); all allowances are subject to fair-use and anti-abuse controls, including rate limits.

6. Acceptable use and moderation

You agree not to use the Service to create or share content that:

  • is illegal, or promotes illegal activity, violence, or self-harm;
  • harasses, defames, or impersonates any person, or presents a real, identifiable person in a false or harmful light;
  • is sexually explicit or sexualizes minors in any way;
  • is deceptive — including presenting generated fiction as real news or factual events;
  • infringes anyone's intellectual property or privacy rights;
  • attempts to probe, overload, or abuse the Service, its APIs, or its rate limits.

Prompts and generated scripts pass automated moderation before rendering, and we may review, refuse, or remove content and suspend or terminate accounts that violate these rules. Public share links for removed content stop working.

7. Your content and ownership

You own your renders. As between you and us, you own the videos you render and the prompts you write, to the extent permitted by law, and you may use them commercially. You are responsible for how you use and publish them.

If you make a video public, you grant us a non-exclusive, worldwide, royalty-free license to host, display, and promote that video on the Service (for example on the shared video page and community showcase) for as long as it remains public. Un-sharing a video ends that display license.

Generated output depends on third-party AI models; similar prompts may produce similar output for other users, and we cannot guarantee uniqueness.

8. Our intellectual property

The Service — including its software, design, and branding — is owned by us or our licensors. These Terms do not grant you any right to use our trademarks or branding.

9. Third-party services

The Service depends on third-party providers, including Clerk (authentication), Stripe (payments), AI model providers (script and video generation), and hosting infrastructure. Trend data is sourced from public platforms; we do not control and are not responsible for the content of those platforms.

10. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including fitness for a particular purpose, non-infringement, or that generation will be uninterrupted, timely, or error-free. Render times and availability depend on third-party model providers.

11. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the Service. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim arose or USD $100.

12. Termination

You may stop using the Service and delete your account at any time (see the Privacy Policy for deletion). We may suspend or terminate access for breach of these Terms, unlawful use, or risk to the Service or other users. Sections that by their nature should survive termination (including ownership, disclaimers, and liability limits) survive.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be announced on the site or by email before they take effect. Continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the operator's jurisdiction of establishment, without regard to conflict-of-law rules. Mandatory consumer protections of your country of residence remain unaffected.
